I succeeded in creating law of first impression proving to the Supreme Judicial Court that the statutory language based on the interpretation of the habitual offender statute (G.L. c. 279, § 25) necessitated clarification. As this issue had never been addressed before in the Massachusetts courts, I obtained review through a very rarely granted procedure of appellate review (G.L. c. 211, § 3). Commonwealth v.
